MEDICAL MALPRACTICE

WHAT ARE POSSIBLE EXAMPLES OF MEDICAL NEGLIGENCE?

  1. A doctor improperly performs your surgery, such as liposuction, endometrial ablation, fat transplantation, carotid artery angioplasty, laparoscopic cholecystectomy, or for an aneurysm.
  2. A doctor fails to properly prevent or respond to your medical emergency, such as fat emboli syndrome, stroke, or heart attack.
  3. A pharmacist gives you the wrong drug or the wrong dosage of a drug.
  4. A doctor fails to properly diagnose or treat your disease or infection, such as Group B Strep, Legionnaire's Disease, Lyme Disease, Crohn's Disease, meningitis, or E. coli infection.
  5. A radiologist does not properly review your x-rays or CT scans.
  6. A doctor improperly places a central line, causing brain damage and cerebral palsy.

DO I HAVE A MEDICAL MALPRACTICE CLAIM?

If you believe your doctor, pharmacist, nurse or hospital made a mistake and you believe that mistake has caused you a serious injury, you may have a medical malpractice claim. Our law office consults with experts on medical malpractice cases from around the country and will give you the opinions of those experts if we feel your case may be a valid one. In order to proceed with a medical malpractice claim, an expert must be willing to testify that your doctor, nurse, pharmacist, or hospital did not satisfy, what is called in legal terms, the appropriate standard of care. That is where these consulting experts come in and can help evaluate the claim.

I BELIEVE MY FORMER DOCTOR MAY HAVE COMMITTED MALPRACTICE. IS IT OK TO ASK MY PRESENT DOCTOR IF HE BELIEVES MALPRACTICE HAS BEEN COMMITTED?

That depends on the relationship you now have with your present doctor. Some doctors do not want to get involved when they are asked questions about whether other doctors committed malpractice. So, you must be careful in bringing up this issue with your current doctor. It may be that you will want to talk with an attorney first and have the attorney evaluate the claim rather than discuss this situation with your current doctor.
